Employment tribunal proceedings for claimant

  • Acted as a sole lay representative for the claimant (Senior Manager) in a defended breach of contract claim, concerning whether there was a contract between parties following acceptance of a conditional job offer.
  • Averted early strike-out of claim by Tribunal, by making researched written representation to Tribunal on ‘consideration’ highlighting flaws in the Tribunal’s initial construction.
  • Made an oral application at hearing (on my feet), seeking to amend losses claimed from 1 month of wages, to 3 months. Application was resisted, but successfully obtained order.
  • Conducted advocacy in the ET. This included cross-examining two witnesses of the defendant and making oral submissions having pre-drafted skeleton argument.
  • Achieved positive findings of fact, claim failed in law and is now subject to full hearing in the EAT.
